By accessing or using the Gigbuilder website, software, or services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. Gigbuilder reserves the right to update these Terms at any time; continued use constitutes acceptance of changes.

1. Use of the Service

Eligibility: You must be at least 18 years old to use the Service. You represent that you have the authority to bind any entity you represent.

Account Registration: You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

Permitted Use: The Service is for managing DJ and event planning businesses. You may not use it for illegal purposes, to violate rights of others, or to transmit harmful content (e.g., viruses, spam).

Prohibited Conduct: Do not reverse-engineer, decompile, or attempt to derive source code from the Service. No automated scraping, excessive use that disrupts the Service, or resale without permission.

2. Subscriptions and Payments

Plans: Service is offered on subscription plans (Basic, Pro, Premium) with a 30-day free trial. After trial, fees apply as listed on the pricing page.

Billing: Monthly or annual billing via credit card or other methods. Fees are non-refundable except as required by law. We may change prices with notice.

Cancellation: Cancel anytime; access ends at billing period close. No prorated refunds.

Taxes: You are responsible for applicable taxes.

3. Intellectual Property

Ownership: Gigbuilder owns all rights to the Service, including software, logos, and content. You receive a limited, non-exclusive license to use it during your subscription.

User Content: You retain ownership of content you upload (e.g., event data, music lists). You grant Gigbuilder a license to host, display, and use it to provide the Service.

Feedback: Any suggestions you provide become Gigbuilder's property.

4. Data and Privacy

We collect and use data as described in our Privacy Policy (linked here), which is incorporated into these Terms.

You agree to comply with data protection laws (e.g., GDPR, CCPA) when handling client data via the Service.

5. AI Features

AI tools (powered by Grok) are provided "as is." You are responsible for reviewing AI-generated content (e.g., emails, suggestions) for accuracy.

Do not input sensitive or confidential data into AI features without ensuring compliance.

6. Termination

We may suspend or terminate your account for violations of Terms, non-payment, or at our discretion with notice.

Upon termination, you lose access; data may be deleted after 30 days.

7. Disclaimer and Limitation of Liability

The Service is provided "as is" without warranties. Gigbuilder is not liable for indirect, consequential, or punitive damages.

Liability is limited to fees paid in the last 12 months. Some jurisdictions may not allow limitations, so they apply to the extent permitted.

8. Indemnification

You agree to indemnify Gigbuilder against claims arising from your use of the Service, content, or violations of Terms.

9. Governing Law

These Terms are governed by California law, without regard to conflict of laws. Disputes shall be resolved in San Francisco courts.

10. Miscellaneous

Force Majeure: Not liable for delays due to events beyond control (e.g., natural disasters).

Severability: Invalid provisions do not affect the rest.
